Federal overtime basics

40-hour weekly threshold

Under the FLSA, hours over 40 in a workweek typically require 1.5× pay for non-exempt employees.

Daily overtime (state)

California and some other states require OT after 8 hours in a day or 12-hour double time.

Exempt vs. non-exempt

Salaried exempt employees are generally not eligible for overtime regardless of hours worked.

Overtime and double-time pay

Overtime must be calculated on a workweek basis under federal rules. Employers cannot average hours across two weeks to avoid OT.

Step-by-step

  1. Enter regular hourly rate and hours at straight time.

Worked examples

Standard workweek

$20/hr × 40 regular + $20 × 1.5 × 5 OT = $800 + $150 = $950.

Double time

$25/hr × 40 + $25 × 2.0 × 3 = $1,000 + $150 = $1,150.
